Attempt to Cap Contingency Fees Threatens More Than Plaintiffs Bar

Forum Column - By Charles B. Parselle - Proposition 202 is now on the ballot. It is called the Lawyer Contingent Fee Limitation Act. It provides "an attorney shall not contract for or collect a contingency fee in connection with a tort claim or a claim for personal injury or wrongful death ... in excess of 20 percent of the amount recovered for a claimant." That 20 percent is net, meaning after deduction of costs.
