'Hoffman' Will Affect the Seven Million Undocumented Workers in the U.S.
Focus Column - By Joseph L. Beachboard - In the latest 5-4 ruling in an employment-related case, the U.S. Supreme Court has held that an undocumented worker who was allegedly terminated for supporting a union may not recover his lost wages. Hoffman Plastic Compounds Inc. v. N.L.R.B., 122 S.Ct. 1275 (2002). According to the majority, such awards would condone prior violations of the immigration laws and encourage future violations.
