Amendment Has Made Interlocutory Orders Final

Focus Column - Litigation - By David Burkenroad - Since Code of Civil Procedure Section 1008 was amended in 1992, it has drastically changed the rules of the game. It has converted what were previously interlocutory orders that did not have res judicata effect into effectively final and unmodifiable orders. This means that parties now have a powerful tool to bar the litigation of issues previously decided by motion.
