Gay Spousal Insurance Case to Proceed

A federal judge denied a motion to stay a Northern District case challenging the federal Defense of Marriage Act.

SAN FRANCISCO - A federal judge on Thursday denied the Obama administration's motion to stay a case in which gay California state employees are challenging their spouses' exclusion from a long-term care insurance program. The Department of Justice had asked for a stay to give Congress time to decide whether to intervene in the case to defend the constitutionality of the federal Defense of Marriage Act....
