9th Circuit to hear argument to dismiss appeal in NSA spying case

The government has moved to dismiss an appeal in a class action against the NSA alleging unconstitutional spying on American citizens.

For the second time in its seven-year history, a case from the Electronic Frontier Foundation against the National Security Agency for unconstitutional spying is before the 9th U.S. Circuit Court of Appeals. The appellate panel will hear arguments Wednesday, as the government seeks to dismiss an appeal by the plaintiffs, a group of AT&T customers, for lack of standing.
