The California Supreme Court recently held in two separate cases that under California's unfair competition law, Business and Professions Code Section 17200 et seq., "fluid recovery" is unavailable in representative actions and restitution includes unpaid wages. The court declined to decide when a restitution award to nonparties in UCL cases violates due process.
