Two convictions OK for one rape, state high court rules

The California Supreme Court, known for its unanimity on decisions, was split Thursday on whether a defendant can face multiple convictions of rape for one act against an individual victim.

The state Supreme Court, known for its unanimity on decisions, was split Thursday on whether a defendant can face multiple convictions of rape for one act against an individual victim.

Applying a "fresh look" at the penal code and the legal landscape, a 5-2 majority held that defendant Billy Charles White can be convicted of both rape of an intoxicated person and rape of an unconscious person.
