Jury Instruction Said Life 'With' Parole, Not 'Without'
SAN FRANCSICO - An incorrect word in a jury instruction, which gave it a contrary meaning, prompted a federal appeals court Thursday to overturn a 1985 death sentence just two days after the panel snatched the case from a federal judge who was about to let the defendant volunteer for execution.
