Divided state high court sides with defendant in gang sentence enhancement

In an opinion that appeared to solidify the bench's emerging liberal bloc, the state Supreme Court voted 4-3 that prosecutors did not prove enough in a gang case to warrant a sentence enhancement under a street terrorism statute.
