Fee shifting, forum selection rules approved by corporate law section of DE State Bar

A green light next Thursday by the bar's executive committee could send the recommended provisions to the state Legislature for a vote later this year and, if passed into law, would overturn significant court decisions on both issues.

The Corporate Law Section of the Delaware State Bar on Thursday approved a handful of proposed amendments to the state's corporate code, including a ban on fee-shifting bylaws and a narrowing of the forum selection process for corporations.
