NLRB asks for en banc rehearing on class action waivers

The National Labor Relations Board petitioned the 5th U.S. Circuit Court of Appeals to rehear a much-watched case over one of the main tools used by employers to avoid class action litigation.

The National Labor Relations Board petitioned the 5th U.S. Circuit Court of Appeals to rehear a much-watched case en banc Thursday.


The case, DR Horton Inc. v. NLRB, debates one of the main tools used by employers to avoid class action litigation. The board held in 2012 that employers can't require workers to sign so-called "class action waivers" as a condition of employment.
