Convicted murderer James Edward Hardy took another step toward freedom Friday after a divided 9th U.S. Circuit Court of Appeals decided not to reconsider an earlier decision granting him habeas relief.
A majority of active 9th Circuit judges declined to rehear en banc a 2-1 panel opinion in August that ordered relief for Hardy.
