SAN FRANCISCO - The 9th U.S. Circuit Court of Appeals will revisit its March ruling that only an arbitrator, not a judge, can decide whether an arbitration clause in a business agreement amounts to an unfair "take it or leave it" contract.




SAN FRANCISCO - The 9th U.S. Circuit Court of Appeals will revisit its March ruling that only an arbitrator, not a judge, can decide whether an arbitration clause in a business agreement amounts to an unfair "take it or leave it" contract.
The court announced Tuesday that it had voted to reconsider the issue before an 11-judge en banc panel.
