9th Circuit rules prosecutor not immune for false declaration

A Los Angeles County deputy district attorney is not entitled to absolute immunity for misrepresenting a brain-surgery bound witness as a murder victim in order to obtain medical records that were then used against the witness, the 9th U.S. Circuit Court of Appeals ruled Tuesday.
