MONTEREY - The late U.S. Supreme Court Associate Justice Thurgood Marshall was an unseen presence Thursday as U.S. Solicitor General Elena Kagan chatted with Chief Judge Alex Kozinski in an on-stage colloquy that closed out the 9th U.S. Circuit Court of Appeal's annual conference.
