A debtor can avoid a lien on a motor vehicle -- even a Mercedes -- if it is a "tool of the debtor's trade," the 9th U.S. Circuit Court of Appeals ruled Tuesday.
The court said that a Southern California real estate agent who filed for bankruptcy was entitled to keep her Mercedes because it fell under California's "wildcard exemption," which allows debtors to keep certain property. The court cites the California statute ...
