A judge's role as the "gatekeeper" who controls trial testimony doesn't empower her to squelch qualified expert opinion, a 9th U.S. Circuit Court of Appeals panel has ruled.
The unpublished opinion Thursday reversed U.S. District Judge Virginia A. Phillips of Riverside and lectured her on the limits of judicial clout. Scantlin v. General Electric Co., 11-55812.
