Insurer Must Treat Insured Fairly When Settling a Case

Carriers typically contend that they control the right to settle. They point to provisions in insurance policies that require that the insured obtain their consent before entering into a settlement or that the insured "cooperate" in the defense of the underlying lawsuit.
