'Fair Argument' Standard Creates Unlikely Greens

Focus Column - By Jim Burroughs - Under the California Environmental Quality Act, the "fair argument standard" determines whether a reviewing public agency must prepare an environmental-impact report or whether a "negative declaration" will suffice. It simply requires that if a "fair" argument (not a good argument) is made that a project "may" (not will) have a significant effect on the environment, an environmental-impact report must be prepared - even if the reviewing public agency thinks otherwise.
