U.S. Supreme Court Likely Will Overturn the 'Festo' Decision

Focus Column - By Stephen Byers - On Nov. 29, 2000, the U.S. Court of Appeals for the Federal Circuit fundamentally altered one of the core elements of patent practice. In its en banc decision in Festo Corp v. Shoketsu Kinzoku Kogyo Kabushiki, 234 F. 3d 558 (Fed.Cir. 2000) (en banc), cert. granted, 121 S.Ct. 2519 (June 18, 2001), the court significantly narrowed the traditional protection enjoyed by patent holders against near-copycat competitors known as "the doctrine of equivalents."
