Focus Column - By Michael Cypers, It is common for plaintiffs to sue multiple defendants in a class-action case. At the critical stage of class certification, a defendant may have the ability to successfully raise the "I'm unique" defense. Using this defense, a defendant argues that there are specific reasons why the court cannot certify the case as a class action as to that particular defendant, regardless of whether the court certifies a class action as to other defendants.
