Court: Prosecutors can try case in which alleged victim is married to DA

Calaveras County District Attorney Barbara Yook erected a "Chinese wall" to prevent a conflict of interest, an appellate court panel ruled.

Can a man accused of assault get a fair trial if his alleged victim is married to the district attorney?

A trial court judge ruled that petitioner Shawn J. Melcher could, and on Tuesday, the 3rd District Court of Appeal affirmed that decision. Melcher v. Superior Court of Calaveras County, 2017 DJDAR 3013.
