Retired state employees can avoid payment of damage awards, judge rules

A judge has ruled that the State Personnel Board does not have the power to order former state employees to pay compensatory damages.

SACRAMENTO — A judge has ruled that the State Personnel Board does not have the power to order former state employees to pay compensatory damages.

The decision won't affect damages that a whistleblower could potentially win in civil court. But it could motivate employees named in future cases to resign in order to escape jurisdiction of the agency.
