Before Bakke, a case that turns out not to be moot

When a Supreme Court case becomes famous, we forget what went before. The 1978 Bakke affirmative action litigation, against the University of California Davis medical school, was preceded a full four years earlier by DeFunis v. Odegaard, presenting the same complaint against the University of Washington law school.
