Partial dismissal granted for Oabalon Therapeutics investor suit
Colleen C. Smith of Latham & Watkins won partial dismissal on the grounds the plaintiffs failed to prove a product the company offers was defective.
A motion to dismiss a case against representatives of Obalon Therapeutics Inc. was partially granted, with U.S. District Judge Anthony Battaglia in San Diego ruling that while the plaintiffs failed to prove a gastrointestinal balloon the company offers was defective, the company did omit some damning information.
