Global prisons company sues California over private incarceration law
The suit brought by Michael B. McClellan of Newmeyer & Dillion LLP and Michael W. Battin of Navigato & Battin LLP cites the precedent set by the U.S. Supreme Court in its 1819 McCulloch v. Maryland decision, which ruled a state could not tax a federal bank within its border.




A law written to effectively ban private prisons in California at the new year has been challenged by a global private prison company in a lawsuit alleging Assembly Bill 32 violates the U.S. Constitution .
