Bar’s proposed opinion on cannabis client advice raises concerns

In the proposed opinion, the California Evidence Code would be amended to allow an attorney-client privilege for advising cannabis business clients as long as the advice is in accordance with state and local laws.

Attorneys can ethically advise clients on how to comply with cannabis laws in California, even though cannabis is still illegal under federal law, a proposed State Bar opinion concludes.
