US judge cites CARES act in Uber employee classification suit

U.S. District Judge Edward Chen cautioned it’s too risky to grant an emergency bid to temporarily block Uber from classifying drivers as independent contractors because they could potentially be barred from receiving benefits under newly-passed federal legislation to provide coronavirus relief if they are considered full-fledged employees in California.

SAN FRANCISCO — Despite claims from Uber Technologies Inc. drivers that they are endangering themselves and the public by continuing to work in spite of stay-at-home orders because they are not given state-mandated paid sick leave, a federal judge signaled Wednesday he’s unlikely to force the rideshare company to reclassify its drivers as employees.
