Courts could face historic wave of unlawful detainer cases once they reopen

“I’ve been at it for 25 years and I’ve never seen anything like this. It will be an unprecedented backlog and dysfunction in eviction courts,” said Daniel Bornstein of Bornstein Law.

California attorneys report an unprecedented wave of inquiries from tenants and landlords unsure of their rights as a patchwork of eviction moratoriums and rent deferment plans fundamentally change the rental relationship in the state.

The same attorneys predicted an unprecedented backlog of unlawful detainer cases after the moratorium is lifted as landlords try to collect deferred payments and tenants request jury trials.
