Panel overturns decisions that infringed on Legislature’s water policy authority

The cases concern the Legislature’s passage of the Sacramento-San Joaquin Delta Reform Act of 2009, which created the Delta Stewardship Council.

A state appellate court overturned half a dozen lower court decisions on grounds they infringed on the Legislature's right to set water policy.

Friday's order came in the form of a unanimous, 90-page unpublished decision from the 3rd District Court of Appeal in Delta Stewardship Council Cases, C082944 & C086199 (3rd DCA, filed Aug. 23, 2016).
