Judges denials of zero-bail rule are illegal, defenders say

Legal scholars and criminal defense lawyers say that actions taken by judges and prosecutors to deny zero bail to qualifying defendants is not legal.

Judges and prosecutors throughout the state are exploring ways to skirt the Judicial Council’s emergency zero bail schedule.

And while public defenders who are representing hundreds of clients on the receiving end of that effort are pushing back in court, legal scholars say the council’s emergency rules don’t allow for wiggle room.
