State high court refers urgent writs back to lower courts to use their tools for expeditious handling

Despite some petitioners pleading with the court not to send their matters to “the superior courts of appropriate counties” for adjudication, the Supreme Court ultimately did just that in three separate writ petitions put on expedited briefing schedules last month.

While the state Supreme Court acknowledged the urgent need to adjudicate matters challenging the governor's response to the pandemic, a dissenting statement in a recent writ petition denial reveals a possible rift in how the justices think emergency requests should be handled.
