MDL battle nears over business interruption cases
Amici curiae policyholders, represented by Covington & Burling, argue hundreds of coordinated lawsuits by businesses against insurers is a one-size-fits-all approach that could produce a steering committee without the necessary insurance litigation experience. Meanwhile, one insurance industry brief also opposes the consolidation.




Lieff Cabraser Heimann & Bernstein LLP is in favor of consolidating federal Covid-19 business insurance lawsuits, a position at odds with many policyholders and the insurance industry, according to briefs filed with the Judicial Panel on Multidistrict Litigation.
The firm has sued insurers on behalf of restaurants over claims denials pursuant to civil authority orders and the coronavirus.
