Novel question about litigation finance company’s contract rights sent to NY courts

In its order, the panel concluded it could not decide whether the contracts violated New York usury law.

A 9th U.S. Circuit Court of Appeals panel on Thursday referred to New York courts the question of whether a Santa Rosa personal injury attorney's agreement with a litigation finance company violates that state's usury laws.

The appellate court certified two questions for the New York Court of Appeals in a case pitting Fast Trak Investment Co. LLC against attorney Richard P. Sax.
