Ethics rule issued for appellate justices

State appellate justices who were removed from a case on a peremptory challenge as a trial court judge should disqualify themselves from hearing the appeal, the California Supreme Court Committee on Judicial Ethics Opinions has recommended.
Many Court of Appeal justices previously served as superior court judges. Peremptory challenges don't apply to appeals, but the ethics panel said Wednesday the same principle applies.
