Judge rejects 90-day delay in Sutter Health settlement hearing

David C. Kiernan, head of litigation for Jones Day’s San Francisco office, argued Sutter Health’s financial status and ability to comply with the injunction has changed, and warned the situation is getting worse, with the number of COVID-19 hospitalizations rising 200% over the past few weeks.

A San Francisco County judge rejected Sutter Health's bid for a 90-day postponement of a preliminary approval hearing in its antitrust settlement with the state and private plaintiffs. But during a Thursday hearing, the judge did put off the hearing for a few weeks, sharing the hospital giant's concern about the financial impact of the COVID-19 virus and the rapid increase in cases.
