9th Circuit decertifies class, wipes out remainder of what was once a $454M verdict

The lower court should have decertified the class in a lawsuit against Kimberly-Clark Corp. and a co-defendant over faulty medical gowns, the panel found.

What remained of Michael J. Avenatti's biggest trial win was wiped out Thursday by a 9th U.S. Circuit Court of Appeals panel, which ordered the case dismissed because U.S. District Judge Dolly M. Gee should have decertified the class in a lawsuit against Kimberly-Clark Corp. and a co-defendant over faulty medical gowns.
