US government bid to dismiss False Claims Act case rejected by circuit panel

9th Circuit Judge Kim M. Wardlaw, writing for the panel, ruled the government had no right to appeal a decision by U.S. District Judge Edward M. Chen on procedural grounds, allowing the plaintiff’s $100 million qui tam lawsuit against a mortgage lender to move forward.

The Trump administration has been more aggressively dismissing False Claims Act whistleblower complaints filed on behalf of the government, but a 9th U.S. Circuit Court of Appeals panel pushed back Tuesday when it affirmed a San Francisco federal judge's ruling rejecting the government's motion to nix one case.
