AG can’t prosecute DA’s husband, says defense counsel
David Lacey’s defense lawyer says Xavier Becerra has no authority to file misdemeanor charges in connection with the March 2 incident at the Laceys’ Granada Hills home. Instead, when Becerra made his filing decisions and elected not to pursue a felony, the prosecutorial powers should have statutorily been turned over to the Los Angeles City Attorney, Tyre argued in his demurrer filed Monday with the Los Angeles Superior Court.
