Owners fear delays in decisions on business interruption lawsuit venues

With the number of federal suits reaching 600, an unusual number of plaintiffs’ attorneys are filing motions for remand to state court. To make things even more uncertain, a multidistrict litigation panel in Washington D.C. is still considering consolidating hundreds of business interruption suits into at least four multidistrict litigation according to who the insurers are, which could mean another change in venue for many suits already in progress.

While federal courts scramble to sort through the large number of business interruption insurance lawsuits filed in recent months after shutdown commercial properties were denied coverage, choice of venue continues to be a hotly debated issue as restaurants and retailers fear delayed decisions will mean permanent closure.
