Business interruption rulings on Covid appear to be in favor of insurers

While over 1,000 business interruption claims filed in the U.S. differ from policy to policy, the two most pertinent questions facing judges in motions to dismiss are: “What constitutes physical loss or damage?” and “Does the policy include a virus exclusion?

With two more federal judges throwing out Covid-19-related business interruption coverage lawsuits, the insurance industry appears to have taken an early lead in what has become a worldwide litigation over whether the policies apply. However some say it is still too early to tell.
