9th Circuit to reconsider precedent against conditional reversals

Precedent in the circuit holds the errors in allowing or excluding expert testimony requires a new trial.

The 9th U.S. Circuit Court of Appeals is reconsidering its precedent against conditional reversals, vacating for now a decision granting a new trial to an inmate convicted of assault with a deadly weapon because the trial judge wrongly excluded expert testimony.
