Biological relationship is not required for parent to pass citizen to child, circuit rules

Judge John F. Walter of the Central District of California ruled last year that Ethan Dvash-Banks should be recognized as a U.S. citizen. Ethan and his twin brother, Aiden, were conceived and born during the marriage of Andrew Dvash-Banks and Elad Dvash-Banks.

A biological relationship between a child and a citizen parent is not required for the child to obtain U.S. citizenship, a unanimous panel of the 9th U.S. Circuit Court of Appeals ruled in the case of one twin who was born in Canada to a gay couple.
