Ruling stymies Legislature's attempt to circumvent US immigration law

Judge Ronald Gould of the 9th U.S. Circuit Court of Appeals wrote the 3-0 decision last week that Congress’ authority over immigration law “cannot be manipulated after the fact by state laws modifying sentences that at the time of conviction permitted removal.”

A federal appellate decision that state laws cannot retroactively protect from deportation immigrants who entered the U.S. unlawfully and then committed misdemeanors has exposed a problem for the California Legislature.
