Securities fraud suits revived after novel question is asked

Both rulings reversed rulings by U.S. District Judge Gonzalo P. Curiel of San Diego dismissing shareholder suits against Axos Financial Inc., which operated as BofI Holding Inc. until it was renamed Axos Bank in 2018.

A pair of 9th U.S. Circuit Court of Appeals panel rulings, including one on Tuesday in a question a defense attorney said had never been tested before, have revived two securities fraud lawsuits against a San Diego bank.
