3rd District opinions have sped up since complaint, but still lag, say attorneys

“The burden of cases that have piled up over the past six years has become overwhelming and unmanageable by that court alone,” said appellate attorney Job Eisenberg, who complained to the Commission on Judicial Performance about the tardy handling of cases.

Long-delayed opinions have been coming fast out of the 3rd District Court of Appeal in recent weeks, according to a veteran appellate attorney who filed a complaint about delays in the court. But the lawyer, Jon B. Eisenberg, is continuing to urge California Chief Justice Tani G. Cantil-Sakauye to transfer cases out of the overburdened court.
