Does order to disclose litigation funder signal something new?
After Tradeline Enterprises Pvt. Ltd., an Indian cotton company, lost its antitrust lawsuit against J.G. Boswell Company and Jess Smith and Sons Cotton LLC, lawyers for the defendants have been trying to recover the attorney fees. At the time, the attorney fee award was $5.9 million. It has now gone up to $6.5 million.




A recent ruling requiring a company to disclose the litigation funder backing its $300 million antitrust lawsuit raises the question of whether the case could be the start of more transparency in the way firms raise money for lawsuits.
