Employee arbitration pact doesn’t extend to government, 9th Circuit rules

Although U.S. Labor Secretary Marty Walsh did not sign onto the arbitration agreement between the employer, Larry Browne, and his delivery drivers, Browne argued Walsh had to arbitrate his enforcement action because it was taken on the delivery drivers’ behalf.

An arbitration agreement between an employer and its delivery drivers can't stop the U.S. Secretary of Labor from bringing an employment enforcement action against the employer, the 9th U.S. Circuit Court of Appeals ruled Tuesday.
