US companies might handle China data privacy law well

Since China’s law is similar to Europe’s, law firms will have a road map. Still, questions remain, such as what the level of compliance is going to be or whether the law will be enforced immediately when it goes into effect on Nov. 1.

China’s new data protection law presents a host of issues for U.S. companies, attorneys said Friday, and further contributes to a Balkanization of the internet.

“The localization issues on this are a big one,” said Craig P. Cardon, a partner at Sheppard Mullin. “It makes it much more administratively burdensome to actually transfer data out of China.”
