Lawyers debate if Russia’s invasion of Ukraine was unforeseeable?

“The question that is going to come up is whether the force majeure event was foreseeable. Attorneys could argue the Russian-Ukrainian war was foreseeable due to their history and it will probably be a hotly contested issue,” said Rex S. Heinke of California Appellate Law Group.

It is too early to see the full picture, but business attorneys expect that the provision in contract law that frees parties from fulfilling their obligations in the event of unforeseeable circumstances will likely be a key legal tool in handling commercial interactions affected by Russia's invasion of Ukraine.
